          The City Council will vote Tuesday on a tough new graffiti ordinance that would make it illegal for people to have aerosol spray paint at parks, pools and other public places.

          Painting, etching and chalking of both public and private buildings would be prohibited. Parents of juvenile offenders would be responsible for either removing or paying for the removal of graffiti. And there would be cash rewards for people providing information leading to the apprehension of vandals.

          The proposed ordinance also would authorize City Manager George Tindall to hire city workers at owners’ expense to remove graffiti if the owners don’t remove it after a certain period of time.

          When graffiti is allowed to remain for long periods of time, it creates the impression that it is sanctioned by the community, Police Chief Stanley L. Knee said. 

          Knee, whose officers have arrested 82 vandals in stepped-up patrols since November, said the ordinance will enable police “to round the corner” in the battle against graffiti within 60 to 90 days.

          Most graffiti vandals are between 13 and 18 years of age and are engaged in tagging competition, rather than gang activity, police said.

          Knee said that an onslaught of graffiti in recent months is causing uneasiness in the community and raising residents’ fears that they will become victims of “rowdy intruders.”

          Knee said that first-time offenders would be eligible to enroll in a diversion program and be assigned to 32 hours of removing graffiti. They also would pay a $25 fee for an adult supervisor to oversee their efforts. Their parents would be liable for paying restitution up to $200.

          Second-time offenders will go to Juvenile Court, he said.

          Knee said the proposed ordinance was taken from the best of anti-graffiti laws from several cities and “molded to fit” Garden Grove.

          City Councilman Mark Leyes said last week that he expects the ordinance to encounter no problems with civil liberties issues. “It’s not a constitutional issue to possess a can of spray paint in a public park,” he said.

          “This total disregard of the property of others has become an epidemic,” Mayor Frank Kessler said. “If it is not taken care of right away, it will lead to further deterioration (of the community), and we can’t afford to let that happen.”

          Because it is an urgency ordinance, the new law will take place immediately if adopted, officials said.

           GRAFFITI vandals continue to be a persistent and expensive problem  

          A report on the city’s efforts in the abatement of graffiti tops Tuesday’s agenda for the meeting for the Garden Grove City Council.

          It covers practices by the city’s public works department as well as contract work with Graffiti Protective Coatings, and touches on issues such as the use of standard colors, color matching and private property graffiti. In the latter case, the report notes that state law requires that the city needs to obtain permission from owners or occupants before painting over the “tagging.”

          GRAFFITI ABATEMENT UPDATE AS REQUESTED BY THE CITY COUNCIL (F: 24.5)

          Staff provided a graffiti abatement update noting the program has been in place for

          the past 20 years in conjunction with clean-up of public rights of way. The

          procedures for choosing the one of the four standard colors and color matching were reviewed, as well as addressing graffiti on private property in compliance with

          Government Code Section §53069.3 and the City’s Municipal Code Chapter 8.64. The

          City contracts for graffiti removal and contractor employees are trained in color

          matching. Private property owners who do not remove graffiti are referred to the

          City’s Code Enforcement Division.

          The new Medal of Honor Bicycle and Pedestrian Trail through Garden Grove got approval for trees, landscaping and irrigation and Mayor Steve Jones gave his vision for the path at Tuesday night’s meeting of the City Council.

          On a 6-0 vote – with Councilmember John O’Neill absent – the council approved a contract with Kato Landscape, Inc. worth up to $510,996.60 to plant 363 trees along the length of the land that was once the route of the Pacific Electric right-of-way that ran diagonally through the community from 1905 through the 1970s.

          The project is scheduled to start in early September and be completed two months later.

          “A lot of people are finding this trail and enjoying it,” Jones said. “It’s a great new public amenity. We need to protect it, keep it clean and not let it be taken over by any bad element. I’d like to see retail kiosks along the way and a ‘dog-friendly’”eatery.

          Urban & Community Forestry

          Under the authority of the Urban Forestry Act (PRC 4799.06 - 4799.12) the Urban & Community Forestry Program (UCF) works to expand and improve the management of trees and related vegetation in communities throughout California.

          The mission of the California Department of Forestry and Fire Protection's Urban Forestry Program is to lead the effort to advance the development of sustainable urban and community forests in California. Trees provide energy conservation, reduction of storm-water runoff, extend the life of surface streets, improve local air, soil and water quality, reduce atmospheric carbon dioxide, improve public health, provide wildlife habitat and increase property values. In short, they improve the quality of life in our urban environments which, increasingly, are where Californians live, work, and play.  The program also administers State and Federal grants throughout California communities to advance urban forestry efforts.            Project Reporting (see also Appendix E) Grantees shall report on all projects bi-annually unless notified otherwise by CAL FIRE staff. The  reporting dates shall be for the periods ending: November 30 and May 30. If a grantee chooses to  invoice CAL FIRE more often, a project report must be included with each billing package. Progress  report periods shall not overlap periods covered under previously submitted progress reports.  Reporting shall follow the format provided by CAL FIRE. Information to be submitted includes project  description, project location, funds allocated, matched funds, activities completed, number of trees  planted, vegetation planted and location, maintenance activities conducted, tons of biomass  generated and delivered to a renewable energy facility or mill, net GHG benefit, and co-benefits  achieved such as property acquired to be repurposed as an urban forestry project site and job or job  training information, challenges and solutions, and benefits to disadvantaged communities. Reports must always include the GHG reporting back-up documentation (minimum data collection attributes, or  MDCA, form) required of the grant category and where applicable. Funding recipients that claim to  provide a benefit to a disadvantaged community will need to report on how the project benefits have  addressed the identified community need. These records must be retained for at least three years  after the completion of the project. All projects will be required to track the above metrics during until  project closeout (i.e., when tree/vegetation planting is complete or green infrastructure construction is  complete).
